RULES FOR ACCEPTING FINANCIAL GIFTS
FOR THE PROVISION OF FOUNDATION CONTRIBUTIONS
1. BASIC INFORMATION ABOUT THE FOUNDATION

The Foundation is a legal entity with operations in the Czech Republic and beyond and is established for an indefinite period.
The foundation was founded in 2014.

Purpose and goals of the Foundation:
The foundation is established for permanent service to a socially useful and public benefit purpose. The purpose of the Foundation is as follows:
The Endowment Fund is established for the purpose of direct or indirect material or financial support and assistance to socially or medically weak, endangered or disabled persons living in the territory of Ukraine or its citizens, by providing financial or in-kind endowment contributions directly to these persons, as well as as well as support for entities, institutions and organizations providing care, assistance or support to such persons, in particular such as infant institutions, children’s homes, regional hospitals, educational establishments, etc. operating in the territory of Ukraine, or supporting the above-mentioned persons.
Public benefit:
The purpose of the Foundation is to support the common good in the sense of supporting the above-mentioned social public benefit activities.
2. DEFINITION OF TERMS
THE FOUNDATION is a legal entity established by law for permanent socially beneficial service. Its aim is to raise funds to support the purpose for which it was established. The obtained funds are redistributed by the Foundation to other natural or legal persons and thus fulfills the purpose for which it was established.
The DAR is a financial amount donated to the Foundation by a donor on behalf of the Foundation.
A DONOR is a natural or legal person voluntarily supporting the Foundation in the form of a one-off payment or repeated provision of funds on behalf of the Foundation, ie a gift within the meaning of Act No. 89/1989 Coll., The Civil Code, within the meaning of later regulations.
THE FOUNDATION CONTRIBUTION is a financial amount provided to a natural or legal person for the purpose of supporting its research activities or other activities in accordance with the purposes of the Foundation.
THE BENEFICIARY OF THE FOUNDATION CONTRIBUTION is a natural or legal person who has applied to the Foundation for a contribution (grant) and to whom the Foundation contribution (grant) has been provided by a decision of the Foundation’s Board of Directors.
3. DONORS
The Foundation’s regular donors include especially those who are aware of the essential need to invest in the purpose of the foundation.
When providing a gift, donors are issued a document confirming the receipt of the gift (eg for the purposes of tax relief), or a donation contract is written.
4. METHOD OF GIFTING GIFTS
Donors can help the foundation with their monetary donations as follows:
• cashless through the payment system on the Foundation’s website•
• ccashless payment card VISA or MasterCard on the Foundation’s website
• by direct deposit to the Foundation’s account: Account number: 7777777072. Bank code: 5500. IBAN: CZ13 5500 0000 0077 7777 7072. BIC SWIFT: RZBCCZPP.
• donor sms (DMS).
Donors can make regular contributions of any amount; neither the minimum nor the maximum amount of the gift is specified. By donating, the donor does not commit to any further or other performance.
5. RETURN OF THE GIFT
1. In the event that the Beneficiary does not use the financial gift for the purpose under this contract or the Donor does not prove the purpose of using the financial gift, the parties agree on the termination condition of this contract within the meaning of § 548 paragraph 2 of the Civil Code. is obliged to return the financial gift to the Donor. The deadline for the return of the financial gift is 30 days from the date on which the Donor was requested in writing by the Donor in accordance with this contract to return the financial gift.
6. DISPUTE RESOLUTION
Legal issues arising from this contract and not expressly regulated by this contract are governed by Czech law, in particular the provisions of § 2055 et seq. Act No. 89/2012 Coll., Civil Code. The rights and obligations regulated by this contract are also interpreted in accordance with the provisions of § 2055 et seq. Act No. 89/2012 Coll., Civil Code. At the same time, the parties agree that any dispute arising from this contract will be resolved by agreement at the level of statutory bodies, on which a written record will be made. If no agreement can be reached, either Contracting Party may apply to the court with territorial jurisdiction, unless the parties demonstrably agree that the dispute shall be settled by an arbitral tribunal.
7. CONDITIONS FOR THE PROVISION OF FOUNDATION CONTRIBUTIONS
The provision of endowment contributions is governed by:
• Act No. 89/1989 Coll., The Civil Code, as amended
• the Foundation’s charter
• the statute of the Foundation
In principle, foundation contributions are provided only to persons who have applied for a grant and who have been granted a foundation grant by a decision of the Foundation’s Board of Directors. The Board of Trustees of the Foundation is composed of experts who have capacities in their field. The Board of Trustees always assesses the intention to provide a foundation contribution with regard to the societal contribution of the given activity and always in accordance with the goals of the Foundation.
There is no legal right to provide a foundation contribution.
8. PROTECTION OF PERSONAL DATA
The Foundation is obliged to process personal data of donors from Act No. 89/1989 Coll., The Civil Code, as amended, into annual reports. If the donor requests that it not be included in the annual report, the Foundation will comply with the donor.
Donors‘ personal data are processed in accordance with the GDPR (Regulation (EU) No 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95 / 46 / EC (General Data Protection Regulation).
According to Act No. 89/1989 Coll., The Civil Code, as amended, the Foundation is obliged to process the personal data of the recipients of the endowment contribution into annual reports. If the recipient of the endowment contribution in the amount of up to CZK 10,000 requests that it not be included in the annual report, the Foundation will satisfy the recipient of the endowment contribution.
The personal data of the recipients of the endowment contribution are processed in accordance with the GDPR (Regulation (EU) No. 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data) 95/46 / EC (General Data Protection Regulation).
The Foundation does not provide personal data of donors or recipients of the foundation contribution to any third parties.
9. FINAL PROVISIONS
The donor is obliged to become properly acquainted with these rules before the financial donation is given, and the donor himself confirms that the donor has become acquainted with the purpose for which the Foundation was established, and then with these rules.
The recipient of the endowment contribution is obliged to get acquainted with these rules before taking over the endowment contribution and the donor himself confirms by taking over the endowment contribution that he has become acquainted with the purpose for which the endowment contribution was provided by the Foundation and then with these rules.
The recipient of the endowment contribution confirms that the information provided in the application for the endowment contribution is true and complete.
These Rules for the Acceptance of Financial Donations from the Public and for the Provision of Foundation Contributions are valid from 1 January 2015 and are published in their current version on the Foundation’s website.
